1. The following promotion is intended for viewing in the United States (excluding Puerto
Rico) and Canada (excluding Quebec) only and shall only be construed and evaluated
according to United States and Canadian law. Persons residing in other jurisdictions are
not eligible to win any prizes in connection with this promotion.
2. GAME OF SKILL; NO PURCHASE NECESSARY TO PLAY; WINNER SELECTION. THIS IS A GAME OF SKILL. WINNERS WILL BE DETERMINED BY THE OBJECTIVE CRITERIA SET FORTH BELOW. From all eligible entries received, the winners will be determined by the participant who accumulates the most points during the Point Accumulation Period, for ESPY Challenge (the "Contest") according to the Scoring System, defined in Section 4. No purchase is necessary to play or win.
3. CONTEST PERIOD: You can enter the Contest any time from January 11, 2001 PT to February 12, 2001 at 5:00 p.m. PT. Participation in this Contest from January 12, 2001 PT to February 12, 2001 PT is called the "Registration Period". Play following February 12, 2001 PT is called the "Point Accumulation Period." See Section 4 for more details on entry.
4. ENTRY: In order to earn points for any one game, you must have submitted your picks prior to the Point Accumulation Period as described above. Any participation in the Contest during the Registration Period does not count toward your final score. Enter at the registration page located off of The Contest index page.
To enter, go to the registration page. Only online entries through the registration page will be accepted. No faxed, mailed, e-mailed, or phoned in entries are allowed. Entrants must have Internet access on or prior to the date they enter the Contest to be eligible to participate. You must be a registered user of espn.go.com to enter. Registration is free. Users can enter by registering in one of the following ways:
a) Existing espn.go.com members should sign in to the system with their current membername and password. No other additional information will be requested.
b) Users who are not espn.go.com members can register by clicking on the link located on the front page. These users will be asked to provide their name, address, daytime and nighttime phone numbers, e-mail address, gender, birthday and to select a membername. Espn.go.com will then send these users a password to the specified e-mail address, after which these users can sign in with their membername and password.
MINOR POLICY: Entrants under the age of 18 must first obtain permission of parent/legal guardian before entering online. Minors may enter only after becoming a registered user and providing their parent or legal guardian's e-mail address. EIV will notify the parent or legal guardian when their child has become a registered member of espn.go.com.
Limit one (1) entry per person or e-mail address. If more than (1) entry is received per person or e-mail address only the first entry will be accepted. All materials become the property of the EIV and none will be returned. After entering, entrants may access their team to track performance. Entrants' name and standing may be listed on the espn.go.com website.
In the event of a dispute about the identity of the online entrant, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. Authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide EIV with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
5. How to Play: After registering, entrants will then be asked to correctly predict the winner for each of the fifteen (14) categories of the ESPY awards to be broadcast on February 12, 2001. All online entries must be received by 5:00PM PT on February 12, 2001.
Entrants will receive points for each correct prediction according to the following scoring system:
Five (5) points for each correct prediction in the 8 "Silver" categories. Ten (10) points for each correct prediction in the 4 "Gold" categories.
Fifteen (15) points for each correct prediction in the 2 "Platinum" categories.
No points will be given for incorrect predictions. Total number of possible points: 110.
Entrants will also be asked to answer four (4) tiebreaker questions (only to be used in case of a tie for the grand prize):
Tiebreaker #1 - How many total entrants will participate in "The ESPY Challenge"?
Tiebreaker #2 - How many total commercials will be shown during the telecast?
Tiebreaker #3 - How many winners will not be in a tuxedo?
Tiebreaker #4 - How many winners will thank their mom?
The entrant who comes closest to the correct tiebreaker answer, without exceeding the correct answer, will be determined to be the winner. In all cases in which a tiebreaker is necessary, an entry that does not win a tiebreaker is eliminated from consideration. Entrants may change their selections as often as they like but all selections must be finalized by 5:00PM PT on February 12, 2001.
6. WINNER SELECTION: One (1) Grand Prize will be determined by the following: The entrant who earns the most points from among all eligible entries received will be determined to be the Grand Prize winner. Such determination shall take place on or about February 15, 2001 by ESPN Internet Ventures whose decisions are final. In the event that a tie continues for the Grand Prize even after the tiebreaker questions, the winner will be determined by random drawing from among those entries. In the event that the ESPY Awards are preempted, cancelled, postponed or discontinued, all predictions will be treated as if correct, and the winner will be selected via a random drawing from all eligible entries.
Grand Prize winner will be notified by email, phone, U.S. mail and/or overnight courier within seven (7) days after determination date and must sign and return an affidavit of eligibility and liability/publicity release within ten (10) days following attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. Travel companion of Grand Prize winner must also complete and sign a Liability/Publicity Release and return it along with the winner's documents. If travel companion is under 18, a parent or legal guardian must sign the Liability/Publicity Release. Any prize/prize notification returned as undeliverable may result in disqualification and selection of an alternate winner. If a winner is ineligible an alternate winner will be selected.
By accepting a prize, winner and travel companion grant permission to Pennzoil or General Motors to use their names, photographs, likenesses, voices, prize information and/or biographical information for publicity and promotional purposes without further compensation, unless prohibited by law. The Grand Prize winner must give notice of requested trip arrangements a minimum of four (4) weeks prior to the departure date of the trip. A failure to comply by this date may result in disqualification of the Grand Prize winner and selection of an alternate winner.
7. PRIZES: One (1) Grand Prize winner plus his/her travel companion will receive: a three (3) day/two (2) night trip for two (2) to the Year 2002 ESPY awards. Travel dates: (TBD). Trip consists of: two (2) coach round-trip airfare tickets to a commercial airport in the vicinity of the Year 2001 ESPY awards from the commercial airport within the U.S closest to the winner, two (2) nights double occupancy hotel accommodations, two (2) tickets to the Year 2002 ESPY awards and $250 in spending money. (Approx. retail value: $3,500.) Odds of winning depend on the number of eligible entries received. No substitution or transfer of prizes or cash equivalent is permitted, but Sponsors reserve the right to substitute a prize of equal or greater value if advertised prize is unavailable.
In the event that the Year 2002 ESPY awards is postponed or cancelled for any reason, the Grand Prize winner will be awarded the trip to the city where the Year 2002 ESPY awards were to be held without the two (2) tickets to the Year 2002 ESPY awards. Grand Prize winner and travel companion are responsible for transportation to and from airport of origination and destination. Grand Prize winner and travel companion must agree to travel on the dates approved/specified by the Sponsors. If Grand Prize winner is unavailable on trip dates, winner may be disqualified and the prize forfeited. All travel dates and arrangements are subject to change and availability. Grand Prize winner and travel companion must travel on the same itinerary and at the same time. Meals, beverages, gratuities, incidental expenses, and all other expenses not specified herein are winner's responsibility. Sponsors will not replace any lost or stolen tickets, travel vouchers, certificates or prize items.
8. ELIGIBILITY: This Contest is open only to legal residents of the U.S., Canada and Puerto Rico only, unless prohibited by law, provided that residents of the province of Quebec may play and have their places noted in the standings, but are not eligible to win any prizes. Canadian winners may be required to take and pass a timed mathematical skill testing question. Minors must first obtain permission of parent/legal guardian before entering online (see "Entry" below). Employees and the immediate families of employees of ESPN d/b/a ESPN Internet Ventures ("EIV"), ESPN, Inc., Go.com, The Walt Disney Company, ABC, Inc., their affiliates, distributors, divisions subsidiaries, licensees, sponsors, licensed retailers, advertising and promotion agencies and Contest promotional partners are not eligible to participate in this Contest.
9. GAMBLING PROHIBITION: ESPY Challenge may not be used in connection with any form of gambling.
10. MAILING LIST: By entering the Contest, you consent to being placed on a mailing list for promotional and other materials unless you "opt. out" pursuant to ESPN.com's privacy policy.
11. NOTIFICATION: Winners will be notified by e-mail and regular mail within thirty (30) days after the date the winners are determined and must sign and return an affidavit of eligibility and acceptance of these Legal Restrictions and a publicity/liability release (unless prohibited by law) within fourteen (14) days following attempted notification. Failure to comply with this requirement may result in disqualification and selection of an alternate winner. Any prize notification returned as undeliverable may result in disqualification and selection of an alternate winner. By accepting any prize, the winners grant permission to EIV, ESPN, Inc., and Pennzoil and General Motors, to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law, and agree to execute a written consent. In the event of a dispute about the identity of any entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. 12. GENERAL RELEASE: By participating in ESPY Challenge, you release and agree to hold harmless EIV, ESPN, Inc., Pennzoil, General Motors, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, successors, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
13. INTERNET/TECHNOLOGY PROBLEMS; RELEASE; DISCLAIMER OF LIABILITY: If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of EIV which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this game and contest, EIV reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend this Contest at any time. Released Parties assume no responsibility for, and will not be liable for, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. No responsibility is assumed for lost, late, misdirected, incomplete or garbled transmissions. None of the Released Parties are in any way responsible or liable for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by EIV on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading of any materials in this Contest. The Released Parties reserve the right at their sole discretion to disqualify any individual who violates these Legal Restrictions referenced herein or engages in any conduct detrimental to EIV, the Contest or any other entrant (in each case as determined in EIV's sole discretion) or to lock out any individual whose eligibility is in question. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, EIV RESERVES THE RIGHT TO SEEK FROM ANY SUCH PERSON DAMAGES AND ANY OTHER REMEDIES AVAILABLE TO EIV TO THE FULLEST EXTENT PERMITTED BY LAW.
14. WINNERS LIST: This Contest is subject to these Official Rules. Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the judges, which are final on all matters pertaining to this game. 15. HEADERS. The section headers contained herein are provided for convenience purposes only and shall not be used to modify or interpret the terms of these Official Rules.
16. SEVERABILITY: In the event that any provision of these Official Rules is found invalid or unenforceable pursuant to judicial decree or decision, the remainder of the Official Rules shall remain valid and enforceable according to its terms. The parties intend that the provisions of these Legal Official Rules be enforced to the fullest extent permitted by applicable law. Accordingly, the parties agree that if any provisions are deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable. |
