NASCAR Online Championship Challenge Official Rules

1. THE FOLLOWING PROMOTION IS INTENDED FOR VIEWING IN THE UNITED STATES, PUERTO RICO AND CANADA (EXCLUDING QUEBEC) ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES AND CANADIAN LAW. PERSONS RESIDING IN OTHER JURISDICTIONS ARE NOT ELIGIBLE TO WIN ANY PRIZES IN CONNECTION WITH THIS PROMOTION. THIS PROMOTION IS VOID WHERE PROHIBITED BY LAW. No purchase necessary to enter.

2. THIS NASCAR CHAMPIONSHIP CHALLENGE (the “Game”) IS A GAME OF SKILL. WINNERS WILL BE DETERMINED BY THE OBJECTIVE CRITERIA SET FORTH HEREIN. From all eligible entries received, the winners will be determined by the participant who uses his or her knowledge of the NASCAR Winston Cup drivers' statistics, relative strengths and weaknesses to accumulate the most adjusted points during the Game Term, defined below, according to the scoring rules below. The Game may not be used in any form of gambling.

3. CONTEST TERM
Entries will be accepted beginning Feb. 8, 2000 and end November 17, 2000 (See Rule 5 for more details). The Game will begin on Feb. 8, 2000 and close on November 19, 2000, at the conclusion of the NAPA 500 (the "Game Term").

4. PRIZES
Three (3) Grand Prize winners will receive "NASCAR Championship Challenge Grand Prize Pack" comprised of Chase Authentics Merchandise. Total retail value: US$200.00, to be awarded after the end of the Game Term and no later than December 31, 2000, (see Rule 7 regarding Winner Selection).

Five (5) weekly prize winners will receive an "NASCAR Championship Challenge Weekly Prize Pack" comprised of Chase Authentics Merchandise. Total retail value: US$20.00, to be awarded on a weekly basis to weekly winners (see Rule 7 regarding Winner Selection).

Prizes are not transferable, no substitution of prizes is permitted, and no cash substitution of prizes is permitted, except that the National Association for Stock Car Racing (hereinafter "NASCAR") and ESPN/Starwave Partners d/b/a ESPN Internet Ventures (hereinafter “EIV”) reserve the right to substitute a prize of equivalent value if any prize is unavailable. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANYPRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS.

5. MEANS OF ENTRY
Entries will be accepted beginning with the first posting of the Game on Wednesday, February 8, 2000, at 5:00 p.m. PT, and will end on Friday, November 17, 2000, at 9:00 a.m. PT. There is no purchase required to enter. Entries will be accepted through the online entry and selection form located at http://games.espn.go.com/cgi/nascar/Request.dll?FRONTPAGE. You must include your first and last name, complete mailing address, country, phone number, age and a valid e-mail address. Only one registration per e-mail address and per person is allowed. If more than one registration is submitted, the most recent registration will be used.

All entries must be received by Friday, November 17, 2000, at 9:00 a.m. PT. No faxed, mailed, electronically mailed, or phoned in entries will be accepted. By entering the Game, you grant to NASCAR, Chase Authentics, Inc. and EIV the right to use and publish your proper name online and in any other media in connection with the Game Furthermore, by entering the Game, you agree that you may receive e-mail regarding future NASCAR and special events and that your name and address may be given to NASCAR merchandising partners. If you do not wish to receive any such e-mail, or if you do not wish your name and address to be given to NASCAR merchandising partners, please indicate so in the space provided on the online entry form.

In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. Authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide EIV with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible.

After registering, contestants can participate in the Game. A valid e-mail address will be used as an identifier to log in to game play, and to keep track of the participant's score. Participants will be able to review their score any time they return to the Game by entering their e-mail address. Participants may join the course of the Game at any time before November 17, 2000 and participate in any number of weeks they choose.

6. SCORING RULES
Using his or her knowledge of NASCAR Winston Cup drivers' statistics and relative strengths and weaknesses, each participant selects a team of NASCAR Winston Cup drivers, while staying under a specified team rating limit, which he or she thinks will compile the most points based on the scoring system described below.

Contestants must stay under the specified team rating limit and must select five (5) players to form a complete active roster. Teams that exceed the team rating limit or do not field a complete roster will receive no points for the week.

NASCAR Drivers residing on the contestant's team will receive points using the following formula: Winston Cup points earned by the driver for position of finish, plus lap led bonuses and most laps led bonuses awarded by NASCAR following each Winston Cup points race.

Team totals are based on the Winston Cup scoring system. The number of points earned by a driver is exactly equal to the number of points awarded to participants who have that driver on their team. The bonuses for most laps led and lap leaders are included in this total (same point structure as Winston Cup Series). Points are awarded for each race, and added to the overall standings. Points will be awarded only to drivers who earn Winston Cup points for that event.

7. WINNER SELECTION
One (3) Grand Prize winner, and Five (5) Weekly Prize winners will be chosen. A valid e-mail address, entered into the registration form, is required to be eligible to win (see Rule 8 regarding Eligible Entries).

From all eligible entries received, the Grand Prize winner will be judged by EIV as the participant with the highest number of points earned over the course of the each of the three segemnts in the Game Term. Five (5) Weekly Prize winners will be selected over the Game Term. A Weekly Winner will be the Five participants with the highest number of points earned during any select week.

Tie Breakers: Should a tie exist between two or more entrants eligible for weekly prizes, the winner will be the team that has the highest overall score. Except for the first week of the Contest Term, in which the winner will be decided by the team that has the highest overall score following the second week.

Should a tie exist between two or more entrants eligible for the grand prize, the winner will be the team that has the highest score in the final week of the game segment. If a tie persists, the winner will be the team with the highest score for each the previous weeks until a winner is determined.

Prize winners will be posted online on NASCAR Online, and notified by mail within seven (7) days after the determination date and must sign and return an affidavit of eligibility and publicity/liability within fifteen (15) days following attempted notification. Any prize notification returned as undeliverable may result in disqualification and selection of an alternate winner. By accepting prizes, the winners grant permission to NASCAR and EIV to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law, and agree to execute a written consent. All prizes will be sent to winners via U.S. Mail.

8. ELIGIBLE ENTRIES
Only complete entries from residents of the U.S., Canada (excluding Quebec), will be eligible to win prizes. Residents of all other jurisdictions may play and have their places noted in the standings (unless this Game or entry into this Game is prohibited by applicable local law), but are not eligible to win any prizes. This Game is void where prohibited by law. An entry is complete only if it includes the following valid and correct information: e-mail address, first and last name, complete mailing address, phone number and age as of the date of entry. All other entries will be ineligible. Persons under the age of 18 as of the date of entry of this Game (“Minors”) may enter the Game only with parental permission. If any prize is won by a Minor, the parent or legal guardian of such Minor must sign and return the affidavit of eligibility and publicity/liability release and the prize will be awarded to the parent or legal guardian. Employees of NASCAR, EIV, Chase Authentics, Inc. , ESPN, and Starwave Corporation, Infoseek, and the distributors, affiliates, divisions and subsidiaries, licensees, licensed retailers and the immediate families of all of the foregoing are not eligible.

9. DISCLAIMERS; LIMITATION ON LIABILITY; DISQUALIFICATION.
No responsibility, damage, loss or injury is assumed by NASCAR, Chase Authentics, Inc. ,Infoseek EIV, or any subsidiary and/or affiliated company of any of the foregoing (collectively, the "Released Parties") for (i) incomplete, late, lost, damaged or misdirected entries, (ii) any printing or typographical errors in any materials associated with the Game, (iii) any computer malfunction, bug, error or any other technical malfunction and/or problem; or (iv) any use of the prizes. By participating in the Game, you (and, if you are a minor, your parents or legal guardians) release and agree to hold harmless the Released Parties from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Game (including the software associated with it) or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. IF YOU ARE A MINOR, YOUR PARENTS OR LEGAL GUARDIANS FURTHER AGREE TO INDEMNIFY EACH OF THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES DESCRIBED IN THE PRECEDING PARAGRAPH WHICH MAY BE SUFFERED BY YOU. EIV reserves the right at their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Game; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NASCAR AND EIV RESERVE THE RIGHT TO DISQUALIFY SUCH INDIVIDUAL AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

10. COMMISSIONER'S POWERS
EIV will act as the Commissioner for all leagues. The Commissioner will have the power to rule on all aspects of the 2000 NASCAR Championship Challenge game, including but not limited to: league business, player trades, infractions of these rules and disputes among franchise owners. The decisions of the Commissioner shall be final and irreversible. The Commissioner has the right to make any necessary changes to the game and rules as the season progresses.

11. RULES
This Game is subject to both these complete Official Rules and all applicable federal, state and local laws and regulations. By participating in this Game, you acknowledge that you have read the rules and agree to abide by their terms and by the decisions of NASCAR and EIV, which are final and binding on all matters pertaining to this Game. NASCAR and EIV reserve the right to change these Official Rules at any time, in their sole discretion.
